Subject: Pay Revision of Board & below Board level Executives of Central Public Sector Enterprises (CPSEs) w.e.f. 01.01.2007 — Government decision on the recommendations of the Anomalies Committee- regarding. 

The Department of Public Enterprise (DPE) vide O.M. No.2(70)/2018-DPE (WC)-GL-XVI/08 dated 26.11.2008 established an Anomalies Committee consisting ofthe Sectætaries or the Department of Public Enterprises, Department of Expenditure and Department of Personnel & Training. The Anomalies Committee was constituted to address issues/problems arising while implementing the recommendations of 2nd Pay Revision Committee (PRC) for the CPSEs by the Government. 

2. The Anomalies Committee gave its recommendations on various issues referred to it by the administrative Ministries/Departments regarding the 2nd PRC related guidelines for its consideration. Consequently, DPE issued the following guidelines vide its OMs dated 26.10.2010, 08.06.2009, 24.09.2010, 0106.2011, 03.06.2011 and 29.06.2012 for implementing the anomalies committee's decisions. 

3. Now for the sake of convenience of all the stakeholders, the said DPE OMs have been collated as under: 

(i) Deputation or the Government Officers in CPSEs 

a) The Government officers already on deputation with the CPSEs as on 26.11.2008 (the date of issue of 0.M. by the DPE regarding the revision of scale of pay of the executives and non-unionised supervisors of CPSEs) will continue to avail of the option already available and exercised by them till the end of their deputation tenure. The extension, if any given after 26.11.2008 will not qualify for this dispensation. 

b) The Board level executives who have been selected through PESB mechanism in IDA scales, and appointed on deputation basis, by ACC/Competent Authority prior to 26.11.2008 will continue to get the same scales with all its associated benefits till the end of their tenure. 

c) It may be emphasized that the pay revision of the executives is a total package and the scales, perks and allowances should not be mixed. Accordingly the executives getting the CDA pay scales will continue to get benefits, perks and allowances applicable to CDA scales and executives who are getting IDA pay scales will get perks and allowances applicable to IDA scales. 

d) The above decisions are enabling provisions. All the conditions indicated in DPE O.Ms dated 26.11.2008, 09.02.2009 and will be applicable mutatis mutandis to such executives also.

(ii) Self-Lease 

(a) Every CPSE must have a Rent Assessment Committee (RAC), which would assess the market tent for categories of executives and non-unionised supervisors, entitled for lease/self-lease accommodation and also the maximum ceiling of reimbursement depending upon the company's capacity to pay. The RAC may include Members from Finance, HR., Civil Engineering, Law etc. as deemed appropriate. 

(b) The RAC will also decide on rent recovery, for which DPE guidelines as applicable to Board level Executives (10% of Basic pay) will be kept in view. 

(c) For purposes of CTC, 30% of Basic Pay is required to be considered on housing as per Para 8 of DPE O.M. dated 26.11.2008. This is not meant to a ceiling and tberefore, this should not be treated as the maximum limit for a leased accommodation. 

(d) The Board of Directors of CPSEs must ensure that self-leased accommodation does not become an additional source of income to the employee. The precautions as indicated in DPE O.Ms dated 20.05.2009 and will also be kept in view. 

(iii) Expenditure on Hospitals, Colleges, Schools. Clubs etc. 

The percentage towards expenditure on Hospitals, Colleges- Schools, Clubs etc. should be as close to actual and should be assessed preferably every financial year. 

(iv) Encashment of Leave

(a) DPE O.M. dated 05.08.2005 provides for a maximum ceiling of Earned Leave that can be accumulated. CPSCs are not permitted to encash leave beyond 300 days at the time or retirement of an employee of CPSE. The employees are not permitted to accumulate more than 300 days as specified under DFE guidelines. 

(b) Casual Leave must not encashed at all and shall lapse at the end of the calendar year.

(c) The component of leave encashment during service i.e. the expenditure on leave encashment, will not be treated Perks and Allowance. It will not however, be treated as pay and accordingly not qualify for any other benefit like HRA. etc. 

(d) Leave encashment on Superannuation will not be part of 30% ceiling of Basic Pay and DA for superannuation benefits. 

(v) Non-practicing Allowance(NPA) 

NPA will not be considered as pay for the purpose of calculating other benefits. 

(vi) Keeping various allowances/benefits/ perks including project allowance, higher conveyance allowance to persons with disabilities, etc. outside the 50% allowances ( i.e. Of Basic Pay). 

No other allowances/benetit/perks will be kept outside the prescribed 50% ceiling except the four which have been mentioned in the DPE O.M dated 26.11.2008. 

(vii) Procedure of pay fixation in some past cases of pay of Board Level Executives 

a) Since the percentage based increment during the periodicity of 1997 pay revision was granted with the approval of the Competent Authority to specific CPSEs, would not be proper to consider notional increment and stagnation increment based on fixed elements. 

b) Stagnation increment can only be granted after reaching the maximum of scalc of pay. once after two years and a maximum of three only. This mechanism was applicable upto 31.12.2006. 

(viii) Bunching of Increment.

The benefit of bunching of increments be extended to board executives of CPSEs also, where applicable, as per para (iii) of DPE 0M. dated 26.11.2008.

4. Any decision as mentioned above, if result in financial burden on the concerned  CPSE, it may be requested to keep in mind the provisions relating to affordability, no budgetary support from Government, internal generation of resources, sustainability and capacity to pay by 
the concerned CPSE. 

5. The effective date, if not specifically mentioned above would be dealt per the DPE OMs dated 26.11.2008, 09.02.2009 and 02.04.2009. 

6. All administrative Ministries/Departments are requested to bring these consolidated DPE  guidelines to the notice of CPSEs under their administrative control for strict compliance.

January 24, 2018: IRTSA office bearers met Shri. D.K. Gayen, Member (Staff) Railway Board at Chennai during his visit to ICF. E.Ramesh Sr.Org Secy felicitated MS on behalf of IRTSA and K.Gobinath Zonal Secretary ICF handed over memorandum on main demands of IRTSA. K.V.Ramesh Sr.JGS IRTSA explained the demands of Technical Supervisors on Pay level & MACPS.

K.V.Ramesh explained that change of eligibility criteria for financial upgradation under MACPS from ‘Good’ to ‘very Good’ has hampered the chances of financial upgardation of senior supervisors and demanded for immediate withdrawal of eligibility criteria ‘very good’.

Inclusion of training period for the purpose of MACPS is also need to be addressed by Railway Board, it was explained to Member Staff that DoPT is the nodal agency for implementation of MACPS rules for all central Government departments including Railways. Ministry of Communication & IT is accounting the period of pre-appointment training for the purpose of MACPS and same is needed to be extended in Railways.

He further briefed on the demand of implementation date of MACPS w.e.f. 1.1.2006. As per Gazette notification & Resolution issued by Finance Ministry, 6th CPC recommendations on pay were implemented w.e.f. 1.1.2006 & allowances w.e.f. 1.9.2008. In its recent judgment, Hon’ble Supreme Court held that financial upgardation under MACPS should be implemented from 1.1.2006, since recommendations of 6th CPC on MACPS is related to Pay, and it cannot be treated as allowance to be implemented from 1.9.2008. MS was urged to take favouable decision on this issue also.

While explaining the demand of Higher Pay level for Technical Supervisors, K.V.Ramesh demanded for implementation of decisions already made by Railway Board in this regard. He briefed that in 2010, Railway Board have send a proposal to Finance Ministry for upgrading the GP of JE from Rs.4200 to Rs.4600 & SSE from Rs.4600 to Rs.4800. Railway Board also send another proposal to Empowered Committee of Secretaries formed after 7th CPC to upgrade 50% of cadre strength of Technical Supervisors to GP Rs.4800. MS was urged for persuasion of Railway Board’s proposal further with Ministry of Finance to get atleast minimum justice for this vital category.

In his reply Member Staff said that, he agrees on the demand of change in eligibility criteria for MACPS and said that this issue is being persuaded by Board with DoPT. On the demand of higher Pay Level for Technical Supervisors, MS said that it under the consideration of Ministry of Railways.

1. Consequent upon implementation of 7th Pay Commission Orders, Maj Generals promoted after 01/01/2016 are drawing more pay than the officers in the same Corps, who were promoted as Maj Generals prior to 01/01/2016. Hence stepping up of pay of Maj Generals promoted prior to 01/01/2016 has been carried out, at par with the pay from the date of promotion of Maj General of that Corps, promoted after 01/01/2016 based on seniority list received from ADGPS . Subsequent increments have been granted thereafter and the pay also revised on promotion to the rank of Lt General, wherever applicable.

2 (a) Consequent upon implementation of 7th Pay Commission Orders, Lt Generals (HAG) promoted after 01/01/2016 are drawing more pay than the Lt Generals (HAG), in same Corps, promoted before 01/01/2016. The case are under examination for stepping up of pay of Lt Generals (HAG) promoted before 01/01/2016, at par with pay from the date of promotion of Lt Generals (HAG), in that Corps, promoted after 01/01/2016.

2 (b) (i) Pay revision in Approx 31 such cases is under progress and will be found adjusted in 09/2017 Pay Account.

2 (b) (ii) In 36 cases of Lt General drawing pay in HAG & HAG(+) scale are under examination and those cases not covered under the provisions of SRO 12 (E) dated 03.05.17 regarding stepping up of Pay, will be taken to CGDA office and IHQ of MoD (Army) / Ministry of Defence for clarification.

2(b) (iii) In 19 cases, where General officers are holding appointment of Army Commanders as on 01/01/2016 drawing maximum pay of Rs.2,25,000/- will not involve any stepping up of pay since there is no pay anomaly.

Sub:- Implementation of Government’s decision on the recommendations of the Seventh Central Pay Commission — Fixation of Pension of Medical Officers retired during 1.1.2016 to 30.6.2017

In accordance with Rule 33 of Central Civil Services (Pension) Rules, 1972 the emoluments reckoned for calculation of pension include Non-practicing Allowance (NPA) granted to medical officers in lieu of private practice.

2. In the case of medical officers who have retired from 1.1.2016 to 30.6.2017, the pension is based on emoluments which included NPA @ 25% of the pre-revised pay. Orders have been issued by Ministry of Finance (Department of Expenditure) vide OM No.12-2/2016-EIII.A dated 7th July, 2017 for grant of NPA to serving medical officers @ 20% of basic pay w.e.f. 1.7.2017. Accordingly, the medical officers retired/retiring on or after 1.7.2017 are entitled to pension based on emoluments which include NPA at the rate of 20% of the revised basic pay.

3. The matter regarding revision of pension of the medical officers who retired during 1.1.2016 to 30.6.2017 based on revised rate of NPA has been examined by the Government. It has been decided that the pension/family pension in respect of medical officers who retired/died during 1.1.2016 to 30.6.2017 shall be further revised w.e.f. 1.7.2017 by adding NPA @ 20% to the basic pay on the date of retirement.

4. The fixation of pension/family pension of retired medical officers in the above manner will be further subject to the condition that emoluments (i.e. Basic Pay + NPA) to be reckoned for pension do not exceed Rs.2,37,500/- (Rupees two lakh thirty seven thousand and five hundred only).

5. This issues with the approval of Ministry of Finance, Department of Expenditure vide their I.D. No. 1(18)/E-V/2017 dated 23rd October, 2017.

Sub: Pay anomaly in the Supervisory Cadre of Accounts Department, Ministry of Railways, and pay disparity with other Supervisory Cadres of the Central Government Services

While deposing before the 7th CPC, this Federation brought to the notice of the Commission that,subsequent to the acceptance of the VI CPC recommendations a peculiar anomaly arosewhere a junior drawing higher Grade Pay than the senior in the cadre of Section Officer(Accounts). The Committee of the 7th Pay commission observed that the above anomalous situation purely arose on circumstantial grounds and needs to be rectified. Thus in its report, the Commission found merit in the above contention and recommended that Seniors must be given the benefit of stepping up and further in line with their recommendations for Organized Accounts Cadres, it further recommended that“Section Officer (Accounts) Railways in GP Rs.4800 should be upgraded, on completion of four years’ service, to the existing GP Rs.5400(PB-2), viz., Level 9 in the Pay Matrix, on non-functional basis.(Ref.: Para No.11.40.83 of 7th CPC).

The 7th Central Pay Commission acknowledged that the skill sets of the Organized Accounts Cadres are fairly higher and the organized accounts cadres have to compulsorily pass various stringent examinations for promotions. Moreover, Sr. Section Officers(A/Cs) had been assigned complete parity with Section Officers(S.O.) of the Central Secretariat Service(CSS) and they had been granted the pay scale of Rs.6500-10500(S-12) w.e.f. 01.01.1996 in accordance with 6th CPC. Further, it was also noted that parity between Organized Accounts Cadres and the cadre of Section Officers of CSS was disturbed by granting non-functional upgradation to GP Rs.5400(PB-3) after four years of service to Section Officers of CSS only. The Commission also noted that, non-functional up-gradation from GP Rs.4800 to GP Rs.5400(PB-3), on completion of four years of service, has been accorded to a number of posts by the Government of India in 2008. The Commission also found no reason and justification to deprive this benefit of upgradation to GP Rs.5400 to the Officers of the Organized Accounts Cadres who are in GP Rs.4800.

“Thus, the Pay Commission recommended that, all officers in the Organized Accounts Cadres (in the Indian Audit and Accounts Department, Defence Accounts Department, Indian Civil Accounts Organization, Railways, Post and Telecommunications), who are in GP Rs.4800, should be upgraded, on completion of four years’ service to GP Rs.5400(PB-2), viz. pay level 9, in the pay matrix”. (Ref. Para 11.12.140 of 7th CPC).

To utter dismay, the Government of India, while accepting the recommendations of the Pay Commission on upgrading of posts, left out the Ministry of Defence and Railways for non-functional upgradation to GP Rs.5400(PB-3) after four years of service for the categories of AAOs(Finance Division of Defence, Ministry of Defence) and Senior Section Officer(Accounts), Senior Travelling Inspector(Accounts) and Senior Inspector(Store Accounts), Ministry of Railways, with the remarks that, “it will be examined by DOPT for taking a comprehensive view in the matter”. The DoP&T took almost nine months and transferred the issue on 7th April, 2017 to the Ministry of Finance(Expenditure). In other words, benefit of upgradation to GP Rs.5400 after completion of four years of service has been granted to all other Organized Accounts Cadres of the Indian Audit and Accounts Department, Indian Civil Accounts Organization and Post and Telecommunications.

The Ministry of Defence in their recent ID Note No.369/C/2017 dated 23.03.2017 also recommended that, “above benefit be extended to the Assistant Accounts Officer(AAO) of Defence Accounts Department”. On the other hand, DoP&T, in their communication ID Note No.1198678/16-Estt.(Pay-I) dated 02.02.2017 to the Executive Director, Pay Commission-III, Ministry of Railways, advised the Ministry of Railways to consult Department of Expenditure since revision of pay scales comes under the administrative domain of the Department of Expenditure in terms of Government of India(Allocation of Business) Rules. It shows the indifferent approach of government of India towards Railway Accounts Employee.

This issue has been elaborated and explained in the tabulated format at Annexure `A’.

The Supervisory Cadre of the Accounts Department of the Railways is also entrusted with the responsibilities of presenting the Railway Accounts on widely accepted of accrual based Accounting in addition to presenting the Government Accounts as per requirements laid down in the Constitution of India, as announced by Hon’able Minister of Railway, Shri Suresh Prabhu, in his budget speech.

It would be highly appreciated, if the benefit of grant of GP Rs.5400 is extended to Supervisory Cadre of the Accounts Department, Ministry of Railways, on completion of four years of service in GP Rs.4800, who are the only left in this case. This will also end pay disparity between the Organized Accounts Cadres of the Government of India.

An early action in the matter shall be highly appreciated.
