Benefit of Reservation – Supreme Court Judgment

Hon’ble Supreme Court judgement dated 15.09.2017 in the SLP(C) No.9574 of 2013 filed by All India Adiwasi Employees Federation against judgement dated 20.12.2012 of Hon’ble High Court of Bombay, Nagpur Bench- Appointment of candidates belonging to Halba Koshti/Halbi Koshti/Koshti etc., castes against vacancies reserved for the Scheduled Tribes.

“The impugned OM squarely makes the law laid down by the Apex Court applicable to all such appointment of the Halba/Koshti, which have become final on or before 28th November, 2000. The Hon’ble Court also held that rather than finding the said office memorandum to be unconstitutional or illegal; it is in consonance with the laws laid down in the judgment of the Apex Court.”

A copy of O.M. No.35034/1/2017-Estt D dated 20.09.2018 issued by the DoP&T on the subject is enclosed. In the said O.M., the DoP&T has stated that their earlier O.Ms dated 27/07/2017 and 28/08/2018 clarifying availability of option for fixation of pay and the date of next increment (DNI) in the lower post and method of fixation of pay from DNI, if opted for, in the context of ccs (RP) Rules, 2016, are applicable in the case of MACP also.

NFIR, therefore, requests Railway Board to issue corresponding instructions in favour of Railway employees duly endorsing copy to the Federation.

Sub: Incidents of violent attacks on Railway employees in the course of performing their duties-reg.

Of late, it is noticed that the Railway employees are becoming targets of physical attacks by the unruly people/antisocial elements. In this connection, NFIR cites the case of recent physical attack on Travelling Ticket Examiner of S.C. Railway (Secunderabad Division) by a group of people who are habituated of travelling unauthorizedly and threatening on duty staff. It has further been reported that three persons have attacked the Gate Keeper (Track Maintainer) at Level Crossing Gate on Northern Railway and chopped off his left arm on 17th September, 2018. Similar attacks on staff were also reported from different places and no adequate action has been taken by the concerned Law & Order Authorities to deter the miscreants.

The Railway Staff who perform duties in the field and at remote places are developing constant fear of criminal attacks on them by the miscreants. In order to maintain the morale of staff, it would be necessary to urge upon the concerned high level authorities who are accountable for maintaining Law & Order situation to take effective measures. So far as Level Crossing Gates are concerned, provision of CCTV cameras may be considered seriously to facilitate detecting the culprits for further action.

NFIR, therefore, requests the Railway Board to kindly see that concrete steps are taken to protect the Railway Staff working in the field and in the remote sections of the Railway system. Federation may please be kept advised of action being taken by the Railway Board early.

Attention is invited to instructions contained in Board’s letter No.E(NG)II/2007/RR-1/10/Pt.(110865) dated 25/06/2014 specifying the carious factors which must be taken into account while computing vacancies for placing indents. It was inter alia mentioned therin that staff likely to go on transfer to other Railways/Divisions in a particular calendar year must also be accounted for in the pool of vacancies while placing indents with the Recruiting Agencies.

It has been observed that large number of applications for Inter Railway transfers are pending on Railways. Such transferred have a direct bearing on railway working, especially in terms of manpower because of huge gap between outflow and inflow of staff.

It is, therefore, reiterated that while placing indents for fresh recruitment notifications in future the computation done duly of vacancies must be done duly taking.into account all the pending requests of Inter-Railway transfers. For this purpose, requests forwarded to the recipient Railway/Division as on the cut off date of assessment of vacancies should be regarded as pending requests. Action may be taken accordingly henceforth.

Kind attention is invited to the references cited above with regard to the subject relating to promotional prospects of staff particularly working in GP 1800/- and 4600/-.

In the above context, NFIR suggests the following for consideration :-

a) The technology inducted in the various categories necessitates improvement in the entry qualification of Technician itself. The Technical staff have conveyed to the Federation that Technician cadre needs to be restructured duly revising the qualification upwardly and for JE’s posts, the entry qualification needs to be revised to BE/B.Tech.

b) The DR quota in GP 4600/- should be eliminated totally and to be filled only by promotion.

c) While the Railway Board had enhanced the entry level qualification for recruitment through all modes in GP 1800/- Pay Level (RBE No.73/2017) in technical departments, the entry level qualification for Technician has not been revised. For irnproving the efficiency levels, this aspects needs to be addressed.

d) As highly qualified staff have joined against safety and other than safety category posts, frustration is growing among them due to no career growth for them. In this connection Federation cites the case of a Senior Technicians on a Zonal Railway who possess MBA/PGD (HRM) qualification but they are not able to become JE/SSE as their qualification is not matching with the requirement. They are also not made eligible to appear for GDCE due to restrictions laid down by the Board. In order to meet the genuine aspirations of these qualified staff on Zonal Railways, the GDCE needs to be improved as below :-

APPEAL TO HELP THE THOUSANDS MAROONED IN RECENT KERALA FLOODS

Your are aware that unprecedented rains in the Kerala State have played havoc within the State leading to tremendous flood situation wherein hundreds of people have lost their lives, rendering thousands homeless besides lakhs have lost their crops and belonging. The situation in the Kerala State is horrible as over 2 lakh people have been evacuated in rain water and consequent floods, leaving aside thousands who have been stranded and waiting for rescue operations and relocation to safer places.

The Central Government, neighbouring State and the public across the country have been contributing significantly and providing help to the State Administration to tide over the gim situation. these efforts are not sufficient considering the massive loss and damage caused due to the natural calamity’

Children Education Allowance and Hostel Subsidy to Railway Employees – Orders issued

Sub: Recommendations of the Seventh Central Pay Commission (7th CPC) – Implementation of decisions relating to the grant of Children Education Allowance (CEA) and Hostel Subsidy – Consolidated Instructions

Please refer to Board’s letter of even number dated 12.10.2017 (RBE No.147/2017) followed by subsequent clarifications thereon regarding grant of CEA and Hostel Subsidy to Government employees on the recommendations of the Seventh Central Pay Commission.

Now, the Ministry of Personnel, Public Grievances and Pensions (Department of Personnel & Training), vide their OM No.A-27012/02/2017-Estt.(AL) dated 16/17.07.2018 (Copy enclosed) has issued consolidated instructions in supersession of all the earlier instructions on the subject of CEA and Hostel Subsidy to Government Servants. These instructions shall apply mutatis-mutandis to Railway Employees with effect from 1.7.2017.

These instructions on CEA and Hostel Subsidy are in supersession of all previous ordrs issued by the Ministry of Railways on the subject.

Sub: Grave injustice done by successive Pay Commission to the category of Junior Engineers and Senior Engineers in Railways-growing dissatisfaction, discontentment and frustration among Technical Supervisors – kind intervention requested.

Ref: (i) Hon’ble MR’s D.O. letter No. PC-VII/2015/R-U/9 dated 20/04/2017 to Hon’ble Finance Minister.

(ii) NFIR’s letter No. IV/NFIR/7 CPC (Imp) /2017/R.B.- Part II dated 19/02/2018 to CRB and copy endorsed to MS. MF, FC, DG(P) etc.

(iii) NFIR’s PNM File No. 03/2018 and 10/2018.

NFIR has been pursuing the case of Graduate Engineers/Diploma Engineers and Supervisory Officials working in different Departments since several years at the level of Railway Ministry for rectifying the imbalances in their pay structure to ensure justice to these Supervisory Officials who have been let down not only by the previous Pay Commissions but also by the Railway Board.

Pursuant to NFIR’s follow up action through PNM fora (Agenda Item No. 03/2018 & 10/2018), the Railway Board through Action Taken Statement dated 10th May, 2018 has conveyed that the proposal regarding upgradation of 75% of Senior Supervisors from Level 7 (erstwhile GP 4600) to Level-8 (erstwhile GP 4800), to bring parity has already been sent to the Ministry of Finance and Hon’ble MR has also sent D.O. letter dated 20th April, 2017 to the Hon’ble Finance Minister seeking approval. The Railway Board has also informed the Federation that a meeting also been held with the Officials of Finance Ministry on 21st February, 2018 and action on hand for obtaining clearance.

NFIR brings to the kind notice of the Hon’ble MR that despite D.O letter of Hon’ble MR vide letter dated 20th April, 2017and discussions held by the Railway Ministry with Ministry of Finance on 21/02/2018, approval of Ministry of Finance has not yet been received. Hon’ble MR may kindly appreciate that in this case the Railway Ministry conceded that grave injustice has been meted out to Graduate Engineers, Diploma Engineers and Supervisory Officials in the Railway resultantly approached the Ministry of Finance to approve for upgradation of 75% posts of erstwhile GP 4600/Level-7 to erstwhile GP 4800/Pay Level-8.

Hon’ble MR may kindly appreciate that on this issue, there was an agreement between the full Board and the Federations for total replacement of GP 4600 (6th CPC)/Pay Level-7 of 7th CPC with GP 4800 (6th CPC)/Pay Level-8 of 7th CPC but sadly, the agreement has not been implemented till date.

NFIR, therefore seeks your kind intervention for the purpose of obtaining approval of the Ministry of Finance for upgradation of posts to GP 4800/- (Pay Level-8) without further delay.

During discussions on some important staff issues on 06th June, 2018 and thereafter, you have assured that the Railway Board would revise the kilometrage rates and other Allowances of Running Staff satisfactorily very soon, taking into account the NFIR’s proposal seeking revision at Rs. 648.

In this connection, I request you to kindly appreciate that the abnormal delay in obtaining the concurrence of Ministry of Finance for revision of kilometrage allowance rates has been causing disappointment among Running Staff. I further bring to your kind notice that while revision of various Allowances has already been granted from 1st July, 2017, this particular case of revision of kilometrage rates for Running Staff is continued to remain pending even after lapse of one year.

I therefore, request you to kindly intervene to see that concurrence of Ministry of Finance is obtained at the earliest for revising the kilometrage rates of Running Staff with retrospective effect. A line in reply is solicited.

NFIR desires to remind the CRB that the Railway Board has unfortunately failed to implement quite a few number of agreements reached with the Federations. One such agreement is “stepping up of pay of Loco Inspectors inducted prior to 01/01/2006” on 6 ½ Zonal Railways.

In this connection, NFIR desires to reiterate that in a full Board meeting held with both the Federations on 07/02/2014, the Railway Board Chairman had given written assurance for implementation of stepping up of pay to the Sr.Loco Inspectors inducted prior to 01/01/2006 (on the remaining 6 ½ Zones), similar to 10 Zones where stepping up of pay to Sr.Loco Inspector had already been granted. The issue thereafter has been discussed very many times by the undersigned with the CRB-latest on 06/06/2018 wherein assurance was again given for quick finalization. On 13th July, 2018, the GS/NFIR has also mentioned to CRB while handing over list of important items pending since long.

Federation also conveys that the Railway Board have lost about a dozen SLPs in the Apex Court as the same, have been dismissed. Similarly, the SLP No. 14746/2018, operative portion of the order is reproduced below:-

“We grant a period of eight weeks to the petitioners to implement the orders. We make it clear that in case the orders are not implemented within eight weeks from today, the arrears will carry interest at the rate of 18% and the officer(s) responsible for the same shall be personally liable for the same.

Pending interlocutory application(s) is/are disposed of”.

Apart from above, Federation also brings to the notice of the CRB that there are about 23 Court cases pending in various Courts on the same subject at Jabalpur, Jaipur, Mumbai, Kolkata, Ernakulam (17 in cases CAT and 6 cases in High Court) where these Courts cannot take a different view than that of orders passed by the Hon’ble Supreme Court. The litigation pursued by the Railway Administration needs to be halted in the interest of Railways and its employees.

Incidentally, it is mentioned that the Federation vide its letter No. II/95/Part X dated 05/10/2017 had apprised the estimated financial implications as a result of allowing stepping up of pay of Chief Loco Inspectors (on remaining 6 ½ Zones). NFIR has also given constructive and workable suggestion during the meeting in the chamber of Addl. Member (Staff) with regard to modification of extant policy for filling the posts of Loco Inspectors so as to avoid further grievances. AM (Elec), AM (Budget) etc., were present in the meeting. If the issue is settled as proposed by the Federation, the above type of problem will not arise in future and there may not be Court cases.

NFIR, therefore, once again requests the CRB to kindly see theat immediate action is taken for granting stepping up of pay to the Loco Inspectors (inducted prior to 01/01/2006 on the remaining 6 ½ Zones) as agreed to already. Federation also requests to see that the Railway Board send reply indicating the progress made for implementation of agreement.

Federation is disappointed to note that despite justification given by the NFIR time and again to the Railway Board at the highest level (Hon’ble MR & CRB), instructions for relaxation from the minimum service condition in the case of re-employed former Defence Forces Personnel to facilitate them to reach their places on inter railway transfer have not been issued. Federation feels sad to mention that through the Action Taken Statement provided during NFIR’s PNM meeting conveys as follows.

“Necessary instructions have been issued vide Railway Board’s letter No. E(NG)I/2015/TR/20 dated 10/02/2017 exempting certain categories of transfer from the minimum 5 years service condition. As decided in the meeting, the case for ex-servicemen was put up to competent authority who has not agreed to the proposal”.

In this connection, Federation invites kind attention of the Board (CRB) to the discussion held by GS/NFIR on 06/06/2018 and again on 13/07/2018 wherein the Federation had again sought intervention of CRB on the subject matter, who in fact agreed and advised officials to process the case for granting relaxation to the former Defence Personnel re-employed in Railways who seek inter railway transfer. But, there has been no progress on the subject.

NFIR, therefore, once again requests the Board (CRB) to kindly see that relaxation to 5 years service condition is granted in the cade of inter railway transfer requests of former Defence personnel re-employed in Railways as a special case.

NFIR – Revision of criteria for “Diet Charges” for patients admitted in Railway hospitals

Ref: This office letter of even number dated 29.10.2010.

The issue of revision of criteria for free/concessional diet for patients admitted in railway hospitals has been engaging the attention of Ministry of Railways for some time. In the meantime, Ministry of Health & Family Welfare, Govt. of India vide their Office Memorandum no S.11011/11/2016-CGHS (P)/EHS dated 09.01.2017 have revised the criteria for diet charges respect of CGHS medical beneficiaries. The Basic pay ceiling for free diet in respect of CGHS beneficiaries has been revised as under:

(i) Basic pay / pension / family pension eligible for free diet—Rs. 44,900/-

(ii) Basic pay/pension/family pension eligible for free diet in case of those suffering from TB or mental diseases-Rs. 69,700/-.

(iii) No provision for concessional diet.

After careful consideration in the matter, it has been decided that the criteria of diet charge fixed by Ministry of Health & Family Welfare for CGHS beneficiaries be adopted mutatis-mutandis for Railway beneficiaries. Accordingly, the revised criteria for diet charges in respect of Railway Medical beneficiaries would henceforth be as under:

(I) Monetary ceiling limit of Rs. 44,900/- (after implementation of 7th CPC) of basic pay/pension/family pension for the purpose of providing free diet to railway medical beneficiaries;

(II) Removal of provision of concessional diet charges contained in instructions dated 29.02.2010; and

(III) Monetary ceiling s. 69,700/- of basic pay/pension/family pension for the purpose of providing free diet to railway medical beneficiaries suffering from Tuberculosis (TB) or mental disease.

This issues with the concurrence of Finance Directorate in the Ministry of Railways.

Various representations have been received for implementation of the above letter w.e.f. 01.01.2016 (the date of implementation of 7th CPC) in place of 23.02.2017.

After careful consideration in the matter, it as now been decided that the revised rate of subscription for joining RELHS would effective from 01.01.2016 in place of 23.02.2017. The excess amount, if any, deducted from the railway employees / family pensioners who retired / sanctioned pension from 01.01.2016 to 22.02.2017 (both dates are inclusive), may be refunded. It will be incumbent upon the department/branch, which paid the settlement dues to the retired employees/ family pensioner, between ‘01.01.2016 to 22.02.2017 (both dates are inclusive), to credit the excess amount recovered, if any, in one go in the bank account of the employee / family pensioner in which the settlement dues was credited. The due amount shall be initiated by the bill preparing authority for the retired employee and shall be passed by the Accounts Department after due internal check. This would be done without any application from the employee / family pensioner.

This issues in consultation with Finance Directorate in the Ministry of Railways.

Sub :- Grant of Overtime Allowance (OTA) to Railway employees consequent upon revision of pay scales and allowances — date of effect.

Please refer this office letter of even number dt. 20.03.2018 (RBE No. 41/2018) on the above subject. In partial modification to the letter dt. 20.03.2018 ibid, it is advised that the second sentence of the said letter may be read as under:-

“This issue of revising the date of effect of OTA w.e.f. 01-01-2016 was taken up by the Federations (NFIR & AIRF), and was also raised in PNM forum by NFIR as item No. 06/2018. The issue has been considered and it has been decided that the basic pay and DA element for the purpose of OTA may be antedated to 01-01-2016 and other elements constituting emoluments for the purpose of OTA viz. HRA and Transport allowance etc. shall be taken into account at revised rates w.e.f. 01-7-2017 as per the 7th CPC recommendations.”

2. This issues with the concurrence of the Finance Directorate of the Ministry of Railways.

Sub: Government’s decision on recommendation of the 7th Central Pay Commission – Transport Allowance to the Railway employees – Deprival of higher rate to those working in pay Level 1 & 2 – reg.

Kind attention of Railway Board is invited to the references cited above.

NFIR reiterates that pursuant to issuance of instructions dated 17/08/2017, situation has arisent wherein the Railway employees in Pay Level 3, drawing pay Rs. 21,700/- and above and also upto Pay Level 8 hitherto entitled for Transport Allowance @ Rs. 3600 + DA thereon (in A1/A class cities and in other cities @ Rs 1800 + DA thereon) have been deprived of the said rate (due to the new norm for entitlement)

In this context, Federation furnishes below the rates granted pursuant to acceptance of the recommendations of the 5th CPC and 6th CPC:-

(a) Recommendations of 5th CPC – Transport Allowance

RBE No. 179/1997 (rates w.e.f 01/08/1997)

From the above, it could be seen that those in pay scale below Rs.6500-10500 i.e. upto Rs. 6000-9800 (S1 to S10A) were allowed Transport Allowance at the uniform rate of Rs. 100/- p.m. in A1/A class cities irrespective of their pay.

(b) After introduction of 6th CPC Pay Band/Grade Pay, the Railway Board vide circular (RBE No. 111/2008 – effective from 01/09/2008 and RBE No. 95/2015) had prescribed following rates for payment of Transport Allowance to the employees.

A comparison of two tables mentioned above, reveals that Railway employees were allowed higher rate of Transport Allowance on their drawing pay Rs. 7440/- irrespective of Grade Pay/Pay Band. However, the modified Board’s instructions issued vide letter dated 03/08/2017 and 17/08/2017,have deprived the Transport Allowance @ Rs. 3600+DA thereon to those in Pay Level 1 and 2 (7th CPC) due to imposition of restriction i.e. reaching the pay Rs. 24700/- Federation, therefore requests the Railway Ministry to kindly refer the matter to Ministry of Finance, for mitigating the problem.

Pursuant to Government decision on the recommenclation of 7th Central Pay Commission, the DoP&T vide No.A-27012/02/2017-Estt.(AL) dated 16/08//2017 had issuecd instructions revising the amount for reimbursement of Children Education Allowance and Hostel Subsidy. The

Railway Board vide RBE No.147/2017 dated l2th Oct, 2017 has issued corresponding instructions to the General Managers for ensuring payment of Children Educaiion Allowance & Hostel Subsidy at revised rates from 01/07/2017.

On Zonal Railways, the staff are facing much inconvenience on account of non-issuance of proper proforma/format for preferring claims, consequently the reimbursement is delayed and claims continued to remain pending due to queries being raised at different levels. It is further learnt that the Eastern Railway, South Eastern Railway and Central Railway have issued proforma/format which are however not common. Other Zonal Railways have not at all issued proforma for preferring the claims. It has however been found that the Eastern Railway Administration has not only circulated format, but also issued JPO.

NFIR is of the view that it would be necessary to bring reimbursement to avoid delay as well staff grievances.

NFIR therefore requests the Railway Board to arrange to issue proper format to enable the employees to prefer claims without hassles together with certificate from the Heads of the Institutions. Such uniform format will be advantageous to the Railway Administration as well to staff who are entitled for reimbursement of Children Education allowance/Hostel Subsidy.
