Vide its orders dated 31.07.17, 31.08.17, 08.12.2017 & 27.03.2018 in file of even number, CBDT had allowed time till 30th June, 2018 to link PAN with Aadhaar while filing the tax-returns. Upon consideration of the matter, the CBDT further extends the time for linking PAN with Aadhaar till 31st March, 2019.

Aadhaar Linkage

Aadhaar Authentication using fingerprint depends upon number of factors viz. quality of fingerprint, network connectivity, placement of finger etc. However, few senior citizens, persons engaged in manual labour or individuals with specific disabilities may face difficulties in fingerprint authentication.

UIDAI provides various modes of authentication viz Demographic, Biometric (Finger Print + IRIS), OTP and Multi-factor authentication. The Service Provider may choose suitable mode(s) of authentication.

As per para 14(1)(i) of Aadhaar (Authentication) Regulation 2016, a requesting entity has to implement exception-handing mechanisms and back-up identity authentication mechanisms to ensure seamless provision of authentication services to Aadhaar number holders.

Further, DBT Mission, Cabinet Secretariat vide their letter dated 19.12.2017 has issued guidelines on exception handling for use of Aadhaar in benefit schemes of Government, which inter-alia has stipulated the following mechanism in respect of cases where Aadhaar authentication fails:

i.Departments and Bank Branches may make provisions for IRIS scanners along with fingerprint scanners, wherever feasible.

ii.In cases of failure due to lack of connectivity, offline authentication system such as QR code bases coupons, Mobile based OTP or TOTP may be explored.

iii.In all cases where online authentication is not feasible, the benefit/ service may be provided on the basis of possession of Aadhaar, after duly recording the transaction in register, to be reviewed and audited periodically.

The Union Minister of State (Independent Charge) for Development of North Eastern Region (DoNER), MoS PMO, Personnel, Public Grievances, Pensions, Atomic Energy and Space, Dr. Jitendra Singh chaired the 30th meeting of the Standing Committee of Voluntary Agencies (SCOVA) here today. The SCOVA meeting is organised by the Department of Pensions & Pensioners’ Welfare (DoP&PW), Ministry of Personnel, Public Grievances & Pensions and the last such meeting was held on January 12, 2017.

During the meeting, Dr. Jitendra Singh said that the SCOVA which was first constituted in July, 1986 would be completing 32 years this year. He said this platform has gone a long way in addressing in a focused manner issues related to Pensioners. He said that today’s interaction was very meaningful and stimulating, thus reflecting on the working of DoP&PW. The Minister while assuring the representatives of pensioners’ Associations said that it was no more mandatory to have one’s Adhaar Card to get his/her pension.

The Minister said that the Department of Pensions has brought out a series of OMs to benefit the Pensioners/Family Pensioners in the last 12 months including enhancing of minimum pension from Rs.3500/- to Rs.9000/- per month; the ceiling of gratuity has been increased from the existing Rs.10 lakhs to Rs.20 lakhs; the rates of ex-gratia lump sum compensation being paid to the families of employees who die in performance of duty has been increased from existing Rs. 10-15 lakhs to Rs.25-45 lakhs. He also said that divorced daughter will be eligible for family pension if divorce case has been filed before the death of pensioner/family pensioner, even though the judgment has been passed after the death of the pensioner /family pensioner.

Dr. Jitendra Singh said that this Government has given relief to the senior citizens and Pensioners in the Budget 2018-19 by allowing Standard Deduction of Rs. 40,000/- per year to the Pensioners and given exemption on tax on account of interest income from bank savings accounts has been increased to Rs. 50,000/ from Rs. 10,000/- per year. Deduction on account of health insurance premium which was earlier allowed at maximum of Rs.30,000/- has now been increased to Rs. 50,000/- in the case of Senior Citizens/Pensioners.

While addressing the meeting he said that we need to put in place an institutionalized mechanism to make good use of the knowledge, experience and efforts of the retired employees which can help in the value addition to the current scenario. Dr. Jitendra Singh said the retired employees are a healthy and productive workforce for India and we need to streamline and channelize their energies in a productive direction. We should learn from the pensioners’ experience, he added. The Minister also said that the DoP&PW should be reoriented in such a way that pensioners become a part of nation building process.

In the meeting, discussions were held on the action taken report of the 29th SCOVA meeting. Further many issues related to pensioners were discussed threadbare, such as revision of PPOs of pre-2006 pensioners, Health Insurance Scheme for pensioners including those residing in non-CGHS area, Special “Higher” Family Pension for widows of the war disabled invalidated out of service, Extension of CGHS facilities to P&T pensioners, issue relating to CGHS Wellness Centre, Dehradun etc. The Minister directed for the prompt and time bound redressal of the grievances of the pensioners and said that we should have sympathetic attitude towards them.

The Secretary, DoP&PW, Shri K.V. Eapen and other senior officers of the department were also present on the occasion. The meeting was also attended by the member Pensioners Associations and senior officers of the important Ministries/Departments of Government of India.

Unique Identification Authority of India (UIDAI), under the Ministry, only issues Aadhaar numbers to the residents of the country, and provides authentication services. It is up to the Departments/Ministries/ Agencies concerned to decide on the use of Aadhaar for providing services/ benefits to the people as per the provisions of the Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016.

The Election Commission launched National Electoral Roll Purification& Authentication Programme (NERPAP), 2015 on 3rd March 2015 in all States/Union Territories with major objective of linking of Aadhaar with Electoral Roll database. In August,2015 when collection, feeding and seeding of Aadhaar number were in full swing, Hon’ble Supreme Court, while considering WP(C) No 494 of 2012 titled Justice Shri K.S. Puttaswamy (Retd.) & Another V/s Union of India & Others), inter alia passed the following interim order on 11th August, 2015:-

“————— 3. The Unique Identification Number or the Aadhaar card will not be used by the respondents for any purpose other than the PDS Scheme and in particular for the purpose of distribution of foodgrains, etc. and cooking fuel, such as kerosene. The Aadhaar card may also be used for the purpose of the LPG Distribution Scheme. —————— ”.

As the Election Commission was one of the respondents in the matter, it had to suspend all activities relating to collection/ feeding/ seeding of Aadhaar number, being undertaken under NERPAP.

The Election Commission has filed Application for Implement (I.A.No. 51252 of 2017) and Application for Directions (I.A No. 51253 of 2017) in the matter on 4th July 2017, before Hon’ble Supreme Court praying to permit the Election Commission to obtain Aadhaar details from the voters who are willing to submit or have submitted it voluntarily in order to link the same with the Voter Electoral Database.

The matter is presently sub-judice. As the matter is still pending before the Hon’ble Supreme Court, the Election Commission has not reviewed its instructions mentioned above. Based on the outcome of the case, the Election Commission will consider the proposal of linking Aadhar number for various electoral services, at appropriate time.

This was stated by the Minister of Electronics and Information Technology in a written reply to a question in the Parliament on 9.3.2018.

Employees’ Provident Fund Organisation (EPFO) has introduced UAN-Aadhaar linking facility for the convenience of members using EPFO Link in UMANG Mobile App.  This is in addition to the existing web facility already available at EPFO’s website www.epfindia.gov.in >> Online Services >> e-KYC Portal>> LINK UAN AADHAAR.

The facility on e-KYC Portal has further added a new feature to link UAN with Aadhaar online using biometric credentials. Using the aforesaid facilities, EPFO members can link their UAN with Aadhaar as under:  

For using this facility with UMANG APP, Member will have to provide his/her UAN. An OTP will be sent to the UAN registered Mobile Number. After OTP Verification, member will have to provide Aadhaar details and gender information (where gender information is not available against UAN). Another OTP will be sent on Aadhaar Registered Mobile Number and/or email. After OTP verification, Aadhaar will be linked with UAN where UAN and Aadhaar details are matched.

For using this facility through E-KYC Portal, Member will have to provide his/her UAN. An OTP will be sent to the UAN registered Mobile Number. After OTP Verification, member will have to provide Aadhaar details, gender information (where gender information is not available against UAN) and select Aadhaar verification method (Using Mobile/email based OTP /using Biometrics). Another OTP will be sent on Aadhaar Registered Mobile Number and/or email or Biometric will be captured using Registered Biometric Device. After verification, Aadhaar will be linked with UAN where UAN and Aadhaar details are matched.

Moving towards Digital India, EPFO has also launched e-Nomination facility for filing nomination form by the member. This functionality is available at Member Interface of EPFO Unified Portal (https://unifiedportal-mem.epfindia.gov.in/memberinterface/). Any member having activated and Aadhaar seeded UAN, can avail this facility.                       

This functionality is independent from employer.  After giving nomination details online, member has to digitally sign the nomination.  Aadhaar based eSign is being used for digital signing of nomination form.  Aadhaar based eSign is being provided to members free of cost by EPFO.  Only member’s mobile number should be linked with Aadhaar.  This functionality will also be made available on UMANG mobile app soon.

(a) whether tier-1 subscribers of NSDL under NPS who have not registered their mobiles with UIDAI are not able to update their Aadhaar numbers and OTPs are not being sent on current mobile number/e-mails registered with NSDL on which NSDL has been sending messages regarding contribution and account statement;

(b) if so, the reasons therefor;

(c) whether Government would provide for sending OTPs to registered e-mails also or on registered mobiles with NSDL;

(d) if so, the details thereof;

(e) if not, the reasons for making the process complicated; and

(f) (f) other measures to ease the process of Aadhaar linking with NSDL?

ANSWER
The Minister of State in the Ministry of Finance

(a) to (e) As reported by the PFRDA, for seeding of Aadhaar, OTP is sent only on the Mobile Number registered with UIDAI data base. Accordingly, OTP is sent to the Mobile Number registered with UIDAI and not to the Mobile Number registered under National Pension System (NPS). However, to enable the subscribers whose mobile number is not registered with UIDAI, an option is available where the subscriber can approach the associated Nodal Office to seed his/her Aadhaar under NPS.

(f) Under NPS, the subscriber can seed his/her Aadhaar online in the Central Record keeping Agency (CRA) system. In addition, the subscriber has an option to approach the associated Nodal Office to seed his/her Aadhaar under NPS.

Subject:– Integration of AADHAR Number With CGHS beneficiary number-

With reference to the above subject the undersigned is directed to state that CGHS is capturing the AADHAR number of new CGHS beneficiaries. while issuing the CGHS Cards, serving employees are already using the Aadhar based Bio-metric attendance system and a large number of primary card holders have linked their Aadhar number to CGHS Ben ID Number, However, some of the existing CGHS beneficiaries particularly the pensioner beneficiaries are yet to link their Aadhar. The matter has been reviewed and it is now decided that linking of Aadhar Number to Ben ID No has been made compulsory and the CGHS beneficiaries are advised to link their Aadhar Number before 31st March 2018.

2.The procedure for doing so is as follows:

(I) Through CMO -In Charge’s Module- Beneficiary can visit CMO-In Charge Of his her CGHS Wellness Centre with AADHAR Card to get his her and family members AADHAR Number linked to CGHS Beneficiary Number.

(II) Registration of AADHAR Number by beneficiary himself/herself – the following steps are to be followed

  • a. Log on to cghs.nic.in
  • b. Click ‘Beneficiary Login’
  • c. Sign in with Ben ID and password if you are already registered.
  • d. If registered Click Generate Pass word and follow instructions to obtain OTP on your registered Mobile Number
  • e. After signing in with Ben ID and Pass word. click AADHAR NO’
  • f. AADHAR for all family numbers and save


3. The co-operation of the CGHS beneficiaries is solicited.

The depositor was required to submit Aadhaar number at the time of opening of account/purchasing certificates. Further, that every depositor who has not given his Aadhaar number at the time of application for such deposit was to submit his Aadhaar number on or before the 31st day of December, 2017.

2. It has now been decided to extend the last date for submission of ‘Aadhaar’ number from 31st December, 2017 to 31st March, 2018.

3. This may be brought to the knowledge of all concerned.

The Department has received 20 complaintsof bank frauds involving Rs.7.65 lakhs connected with linking Aadhaar with bank accounts since 2015,as per details at Annexure.However, for customer protection, zero liability of a customer is assured vide Reserve Bank of India’s (RBI)circular dated 6th July, 2017in all cases of a third party breach where the deficiency lies neither with the bank nor with the customer but lies elsewhere in the system and the customer notifies the bank within three working days of receiving the communication from the bank regarding the unauthorized transaction.On being notified by the customer, the bank shall credit (shadow reversal) the amount involved in the unauthorized electronic transaction to the customer’s account within ten working days from the date of such notification by the customer.

Further, the guidelines inter-alia addresses the following areas for safeguarding the customers while handling the cases of unauthorized electronic banking transactions:

I. Strengthening of systems and procedures
II. Reporting of unauthorised transactions by customers to banks
III. Limited liability of a customer
IV. Reversal timeline for zero liability/ limited liability of customer
V. Board approved policy for customer protection
VI. Burden of proof on banks
VII. Reporting and monitoring requirements]

(c): The Banks have their grievance redressal policy and internal Grievance Redressal Mechanism for resolution of grievances and customer complaints displayed on their respective websites. In case of alleged unauthorised transactions, the case is investigated and settled as per the Standard Operating Procedures (SOP). 

Out of 1.26 lakh overall grievances, 1.20 lakh have been disposed of during the period 1st January, 2017 to 28th December, 2017, leading to a settlement percentage of95%.

(d):In terms of amendments to provisions of Prevention of Money Laundering - (Maintenance of Records) Rules, 2005 issued vide Gazette Notification G.S.R 538(E) dated June 1, 2017, it is mandatory to obtain Aadhaar for linking all bank accounts, insurance, pension, mutual funds and SIM cardsfor individuals who are eligible to enrol for Aadhaar.

This was stated by the Minister Shri Nusain Dalwai in a written reply to question in the Lok Sabha on 2.1.2018.

CBDT extends date till 31.3.18 for linking of Aadhaar with PAN

Under the provisions of recently introduced section 139AA of the Income-tax Act, 1961 (the Act), with effect from 01.07.2017, all taxpayers having Aadhaar Number or Enrolment Number are required to link the same with Permanent Account Number (PAN). In view of the difficulties faced by some of the taxpayers in the process, the date for linking of Aadhaar with PAN was initially extended till 31st August, 2017 which was further extended upto 31st December, 2017.

It has come to notice that some of the taxpayers have not yet completed the linking of PAN with Aadhaar. Therefore, to facilitate the process of linking, it has been decided to further extend the time for linking of Aadhaar with PAN till 31.03.2018.

As per notifications dated 1.6.2017 and 13.12.2017 by Department of Revenue, amendments have been effected to the Prevention of Money-laundering (Maintenance of Records) Rules, 2005 to provide that account-holders eligible to be enrolled for Aadhaar, shall inter alia submit their Aadhaar number to banks, by 31.3.2018 or six months from the date of commencement of account-based relationship by the account-holder whichever is later, for the purpose of Client Due Diligence.

Department of Revenue (DoR) has informed that the objectives of Aadhaar seeding with bank accounts is to weed out bogus, fictitious and benami accounts used for money laundering, terror funding or avoiding taxes and to ensure reduction in leakages of Government spending. For the beneficiaries, Aadhaar has emerged as powerful instrument to establish their identity anywhere at any time, receive entitlements and exercise their rights.

The said rules further provide inter alia that an individual eligible to be enrolled for an Aadhaar number shall, at the time of commencement of an account based relationship, submit the Aadhaar number and, where Aadhaar number has not been assigned, furnish proof of enrolment for Aadhaar.

This was stated by Shri Shiv Pratap Shukla, Minister of State for Finance in written reply to a question in Lok Sabha today.

(b) if so, the action Government proposes to take in the matter;
(c) the total number of ration cards not linked to their Aadhaar unique ID number, State/Union Territory-wise; and
(d) the policy of Government to provide subsidized foodgrains to BPL families?

ANSWER

(a) & (b): The Government of Jharkhand informed that the girl Miss Santosh Kumari of Karimati village of Simdega District died owing to disease and not due to hunger. The Government of Jharkhand has further informed that the family of deceased had Priority Household Ration card which was deleted on 22.7.17. Aadhaar card of mother of deceased was submitted to Fair Price Shop [FPS] in month of August, 2017.

Government of Jharkhand has also informed that District Grievance Redressal Officer[DGRO] Simdega passed an order to pay the food security allowance to the family for the month of August 2017 as per provisions of National Food Security Act, 2013 and that FPS dealer concerned and Incharge Area Supply Officer [Prabhari Prakhand Aapoorti Padadhikari] were placed under suspension and a new Antyodaya Anna Yojna Ration card was issued to household.

Letter dated 24/10/17 have been issued to all State/UT Governments to strictly comply with the provisions of the Notification issued by this Department vide SO No.317[E] dated 8/2/17[as amended from time to time]. The said Notification has clear provisions for distribution of the benefits of subsidized foodgrains/cash transfer of food subsidy under NFSA to those eligible beneficiaries who do not possess Aadhaar number. The notification as well as letter dated 24/10/17 have been uploaded on the official web site of this Department i.e. www.dfpd.nic.in.

(c ): A State-wise statement showing the total number of Rations cards linked/seeded with Aadhaar is at Annexure .

(d): After implementation of NFSA, criteria of identification of beneficiaries/households has been de-linked from BPL/APL categories and beneficiaries are identified under two categories namely;

(i). AAY Households, and
(ii). Priority Households

The eligible households under the above categories are required to be identified by State/UT Governments and are entitled to receive foodgrains (rice, wheat or coarsegrains or any combination thereof) under TPDS @ Rs 3/-, 2/- & Re 1/- per kg respectively with entitlements of priority households being @ 5kgs per person per month and AAY families getting @ 35 kg per family per month as per the AAY scheme.
