Subject: Admissibility of SPORTS (Society for Promotion of Nature Tourism and Sports) tour package to Lakshadweep Islands on ships operated by Lakshadweep Administration on LTC.

The undersigned is directed to say that this Department is in receipt of references seeking clarification regarding the admissibility of journey performed by ships booked through SPORTS (Society for Promotion of Nature Tourism and Sports), Lakshadweep, for the purpose of journeys performed on LTC.

2. The matter has been considered in this Department in consultation with Department of Expenditure and UT of Lakshadweep. It has been decided that the tour pacakages conducted by SPORTS to Lakshadweep Islands on the ships owned and operated by Lakshadweep Administration shall be allowed for the purpose of LTC journey subject to the following conditions:

(i) SPORTS is offering various tour packages to the tourists, fare of which is charged as per the transportation and accommodation chosen for the destination. Only transportation charges shall be reimbursable for the respective tour package.

(ii) SPORTS shall issue a certificate for transportation charges to the Government servants indicating the fare components separately and certify that the journey was actually performed by the Government servant and his family members for which he/she is claiming the Leave Travel Concession.

(iii) Fare reimbursement for the journey performed by boat/ship shall be exercised in accordance with TA entitlement of the Government servant for journey by sea or river steamer.

3. These instructions shall take effect from the date of issue of this O.M. The LTC claims already settled will not be re-opened.

4. In their application to the staff serving in the Indian Audit and Accounts Department, this order issues with the approval of Comptroller & Auditor General of India.

The undersigned is directed to refer to this Department’s Office Memorandum No. 11013/4/2011-Estt.(A) dated 1st December 2011 subsequently reiterated vide D.O. letter dated the October 9, 2012 from Secretary (Personnel), O.M. No. 11013/2/2012-Estt.A dated 19.11.2014 and O.M. of even No. dated 7.02.2018 (copies enclosed) on the subject mentioned above and to reiterate these instructions for strict compliance on the recommendations of the Committee of Privileges, Lok Sabha in its Sixth Report tabled in the Lok Sahha on 20.12.201 7 and Committee on Violation of Protocol Norms and Contemptuous Behaviour of Government Officers with Members of Loic Sabha in its Fourth and Fifth Report tabled in the Lok Sabha on 01.08.2018.

2. All Ministries/ Departments are requested to ensure that instructions issued through aforementioned communications are followed by all officials concerned, both in letter and spirit. Violation of these guidelines will be viewed seriously.

3. Chief Secretaries of all States/ UTs are requested circulate these instructions to all State Government officials at the State/ Division and District levels and sensitize them with regard to their duties and obligations in so far as the movement of Members of Parliament in general and more particularly during Parliament sessions. It is also requested to periodically review implementation of these instructions.

NFIR invites kind attention to the OM dated 09/08/1999 wherein the Government of India (DOP&T) had introduced ‘Assured Career Progression Scheme’ (ACPS) for the Central Government Civilian Employees pursuant to the recommendations of 5th Central Pay Commission. The ACP Scheme was made effective in the Central Government departments from 1999. The ACP Scheme remained functional until 31/08/2008 (as clarified by the DoP&T vide para 9 its OM dated 19/05/2009) due to the fact that the ‘Modified Assured Career Progression Scheme’ was introduced by the DoP&T, replacing ACPS w.e.f. 01/09/2008, pursuant to the recommendations of 6th CPC.

The Federation has however been receiving representations from the Central Government Civilian Employees, mainly railway employees from all corners of the country to make the MACP Scheme operational w.e.f. 01/01/2006 instead from 01/09/2008, pursuant to the order dated 08th December, 2017 passed by the Hon’ble Supreme Court in Civil Appeal Diary No.3744 of 2016. In this connection, NFIR places following facts for consideration:-

On perusal of the order of the Apex Court, it is found that the Hon’ble Apex Court has held that the MACP is a part of pay structure recommended by the 6th CPC, the same cannot be considered as allowance which had been given effect from 01/09/2008. The said order has also cited the Resolution dated 30/08/2008 of the Government which was referred in the notification issued by the Ministry of Finance wherein MACP has been defined part of ‘Pay structure’ and not as ‘Allowance’ and therefore should be given effect from 01/01/2006.
The order dated 8th Dec’2017 passed by the Apex Court has already been implemented by the Ministry of Defence, giving effect to the MACPS w.e.f. 01/01/2006 through an OM dated 25/07/2018.

DoP&T may kindly take note that in para 6.5.2 & 6.5.4 of the report of 6th CPC, the Commission had recommended for implementation of the revised pay structure consisting of Pay Band and Grade Pay w.e.f. 01/01/2006 while the revised allowances were given effect from prospective date i.e. 01/09/2008.

Ministry of Finance vide Gazette of India, Extraordinary Notification of Resolution No. 1/1/2008-IC dated 29/08/2008 had implemented revised pay structure (Pay Band & Grade Pay) w.e.f. 01/01/2006 whereas the implementation of MACPS was made effective from 01/09/2008. Accordingly, Ministry of Railways also implemented revised Pay structure w.e.f. 01/01/2006 vide its order dated 04/09/2008 while the rates of Non Practicing Allowance (NPA) were revised w.e.f. 01/01/2006 vide Board’s order dated 22/09/2008. Therefore, the MACPS which is part of Pay structure as decided by Apex Court should be given effect from 01/01/2006 in railways and all other Central Government departments.
Another important fact which cannot be ignored is, that the Apex Court had held that the benefit of ACP granted to an employee is part of the Pay structure which not only affects the pay but also pension of the employee, therefore, decided that the ACP is not allowance but a part of pay. At the same time, the Hon’ble Supreme Court further held that there can be no dispute that grant of ACP is part of pay structure and that the resolution dated 30/08/2008 relating to implementation of 6th CPC recommendations on pay structure, pay bands, grade pay etc have been given effect from 01/01/2006 and also added that this is the decision of the Cabinet which could not have been modified by issuing executive instructions.

NFIR suggests that while issuing modified instructions, in compliance with Apex Court order, the DoP&T may allow option opportunity to all those beneficiaries of ACPS as well MACPS to exercise their option for financial upgradation from the dates advantageous to them so as to avoid further grievances.

Summing up, NFIR urges upon the DoP&T to kindly consider the above points and issue modified instructions for granting financial upgradation under MACPS with effect from 01/01/2006 as was done by the Ministry of Defence. A copy of the instructions issued may be endorsed to this Federation.

In continuation of this Department’s O.M. No.13024/01/2016-Trg. Ref dated October 24, 2017 on the subject cited above, the undersigned is directed to state that the Office of the Comptroller and Auditor General of India has conveyed their ex-post facto approval for the applicability of the OM No. 13024/01/2016-Trg. Ref dated October 24, 2017 to the employees belonging to Indian Audit and Accounts Department under the presumption that any government servant, who is not a permanent faculty and joins the training academies/institutes/establishments as a faculty is entitled to training allowance vide their ID Note 124/03-2017/Vol.II dated July 2, 2018.

Subject: All India Protest Day for 19th September, 2018 – Instructions under CCS (Conduct Rules) 1964 – Regarding.

It has been brought to the notice of the Government that National Joint Council of Action (NJCA), New Delhi has decided to observe “All India Protest Day” on 19th September, 2018 in support of the following issues:

i. Upward Revision of Minimum Wage and Fitment Formula,
ii. Scrapping of the New Contributory Pension Scheme; and
iii. Allow Option No.1 as one of the Pension Fitment Formula.

2. The instructions issued by the Department of Personnel and Training prohibit the Government servants from participating in any form of strike including mass casual leave, go slow  etc. or any action that abet any form of strike in violation of Rule 7 of the CCS (Conduct) Rules, 1964. Besides, in accordance with the proviso to Rule 17(1) of the Fundamental Rules, pay and allowances is not admissible to an employee for his absence from duty without any authority. As to the concomitant rights of an Association after it is formed, they cannot be different from the rights which can be claimed by the individual members of which the Association is composed. It follows that the right to form an Association does not include any guaranteed right to strike. There is no statutory provision empowering the employees to go on strike. The Supreme Court has also ruled in several judgments that going on a strike is a grave misconduct under the Conduct Rules and that misconduct by the Government employees is required to be dealt with in accordance with the law. Any employee going on strike in any form would face the consequences which, besides deduction of wages, may also include appropriate disciplinary action. Attention of all employees of this Department is also drawn to this Department’s O.M. dated 12.9.2008,
on the subject for strict compliance (enclosed as Annexure-A).

3. All officers are requested that the above instructions may be brought to the notice of the employees working under their control. All officers are also requested not to sanction Casual Leave or any other kind of leave to the officers and employees, if applied for, during the period of proposed protest, and ensure that the willing employees are allowed hindrance free entry into the office premises.

4. In case employees go on protest, all Divisional Heads are requested to forward report indicating the number and details of employees, who are absent from duty on the day of protest, i.e., 19.09.2018.

The undersigned is directed to refer to this Department’s OM of even number dated 27.07.2017, on the subject cited above. Following the issuance of the OM ibid, this Department has received a number of references seeking clarification on various aspects of the OM ibid. The matter has been considered in this Department in consultation with D/o Expenditure and the points of doubt are clarified as under:

Under the changed circumstances, after the issuance of this Department’s OM ibid, the employee shall be allowed to re-exercise/ revise their option for fixation of pay under FR 22(l)(a)(1), within one month from the date of issuance of this OM. Further, the option so revised, shall be final.

Keeping the following objectives in view, the Government of India, Department of Personnel & Training has been encouraging the formation of Residents’ Welfare Associations in Government residential colonies as well as private colonies in which 2 or more Central Government employees are residing in one compact area:-

(a) To foster a spirit of mutual help and goodwill among the inhabitants of the colony in general, and the members of the Association in particular, thereby, promoting communal harmony and national integration.

(b) To make all possible effort to achieve general amenities. Consumer protection such as interaction with traders on quality and quantity of goods, over charging etc. monitoring of the public distribution system including supply of essential and consumable items and environmental protection such as steps to curb pollution, ensure cleanliness, plantation of tress, interaction with authorities on any environmental aspects and for this purpose, represent the interest of the residents before appropriate authorities.

(c) To undertake all such other lawful acts, deeds or thing including Sports Cultural activities as are incidental or conducive to the attainment of any or all of the above objects including the general welfare of the Employees and their families.

(d) To promote such welfare and socio-economic activities as may be approved by the Department of personnel and Training.

2. Welfare Division of the Department of Personnel and Training, with a view to bring about uniformity and to provide guidance to these Association in their organizational matters have formulated a “Model constitution” and “Rules and Regulations” for the Residents Welfare Association. A copy of these documents is enclosed as ready reference.

3. Lately, it has been noticed that the very objective of fostering a spirit of mutual help and goodwill among the inhabitants of the colony has gone on back foot due to growing disputes among the office bearers and members of RWAs and lack of transparency in the functioning of RWAs.

4. In view of the above, a need has been felt to re-visit the Model Constitution and Rules and Regulations for the RWAs. Accordingly, all RWAs and AWOs are requested to suggest modification/amendment in the existing Model Constitution and Rules and Regulations for the RWAs in the following format for comparative analysis and consideration of the suggestion.

Subject: Change of date of holiday on account of Id-u-Zuha (Bakrid) during 2018 for all Central Government administrative offices located at Delhi /New Delhi.

In supersession of this Ministry’s OM of even number dated 14/08/2018 on the subject cited above and on the basis of the report of Ruiyat Hilal (moon deciding Committee) headed by Shahi Imam, Jama Masjid, Delhi, Syed Ahmed Bukhari intimating that witnesses of sighting of moon have been received from different cities of India, it has been decided that in Delhi Id-ul-Zuha (Bakrid) will be celebrated on 22nd August, 2018 instead of 23.08.2018 as notified vide this Ministry’s OM No. 12/3/2017-JCA2 dated 14.06.2017 for all Central Government Administrative Offices at Delhi/New Delhi

2. For Offices outside Delhi / New Delhi the Employees Coordination Committees or Head of Offices (where such Committees are not functioning) can decide the date depending upon the decision of the concerned State Government.

3. The earlier OM issued in this regard vide OM of even number dated 14/08/2018 [ Read this OM ] stands withdrawn.

Subject: Revision of Entitlement of TA/DA to JCM Members after implementation of Seventh CPC recommendations.

The undersigned is directed to say that consequent upon the revision of rates of Travelling Allowance/Daily Allowance by the Department of Expenditure vide O.M. No. 19030/1/2017-E.IV dated 13/07/2017, the Staff Side Members of the National Council (NC)/Departmental Councils and Third Level/Regional Councils of JCM shall be entitled to TA/DA etc. in the following manner w.e.f. 01.07.2017.

A. National/Departmental Council JCM
TA/DA entitlement as admissible to officers in Pay level 12 & 13 as per Department of Expenditure’s O.M. No. 19030 /1/2017-E.IV dated 13/07/2017 as under:
  • (i) Travel entitlement within the country – Economy class by Air or AC-I Class by Train including travel in Premium /Premium Tatkal /Suvidha/Shatabdi / Rajdhani Trains.
  • (ii) Reimbursement for Hotel Accommodation of upto Rs. 4500/- per day. 
  • (iii) Reimbursement of food bills not exceeding Rs.1000/- per day.
  • (iv) Reimbursement of AC Taxi Charges of upto 50 kms per day.


B. Regional/ Office Council (JCM)
TA/DA entitlement as admissible to officers in Pay level 11 as per Department of Expenditure’s O.M. No. 19030 /1/2017-E.IV dated 13/07/2017 as under :
  • (i) Travel entitlement within the country – Economy Class by Air or AC-II Class including Rajdhani/ Shatabdi Express etc.
  • (ii) Reimbursement for Hotel Accommodation of upto Rs. 2250/- per day.
  • (iii) Reimbursement of food bills not exceeding Rs. 900/- per day.
  • (iv) Reimbursement of non-AC taxi charges of up-to Rs. 338/- per day for travel within the city


2. The admissibility of DA in case of free boarding and lodging, has been considered in Department of Expenditure. Daily Allowance is given to the Govt. employees as a reimbursement of the expenditure incurred by him on tour for his stay, food and travel at that station. In case of free boarding and lodging, the Govt. employee, if incurring any expenditure on local travel, can claim the same as per Para 2 E(i) and (iii) of the Annexure to OM No.19030/1/2017 E.IV dated 13.07.2017. The earlier system of giving 25% of DA has been discontinued. Also after implementation of 7th CPC recommendations, the facility of DA at 5th CPC rates is done away with.

3. This O.M. is issued with concurrence of the Ministry of Finance, Department of Expenditure vide I.D. No.300377130/2018-E.IV dated 31.07.2018

There is no proposal to formulate single transfer policy for the Government employees

Single Transfer Policy for both Central & State employees

Transfer Policy

In terms of instructions issued by Department of Personnel & Training (DoPT) on transfer/posting of Government employees, all Ministries/Departments of Government of India are required to have their own guidelines for transfer/posting of their employees providing for the following –

i. minimum tenure;

ii. have a mechanism akin to Civil Services Board for recommending transfer; and

Respective Ministries/Departments are also required to place the transfer policy in public domain.

There is no proposal to formulate single transfer policy for the Government employees as guidelines for transfer/posting of employees depend on the specific requirement of individual Ministries/ Departments. Moreover, the State Public Services are under State List for which the State Governments are competent to make rules and policies. Accordingly, there is no proposal to constitute any commission for single transfer policy for both Central & State employees.

This information was provided by the Union Minister of State (Independent Charge) Development of North-Eastern Region (DoNER), MoS PMO, Personnel, Public Grievances & Pensions, Atomic Energy and Space, Dr Jitendra Singh in written reply to a question in Lok Sabha today.

Sub: Seventh Central Pay Commissions recommendations — revision of pay scales – amendment of Service Rules/Recruitment Rules.

The undersigned is directed to refer to this Department’s OM of even number dated 9th August 2016 regarding amendment of Service Rules/ Recruitment Rules by replacing the existing Pay Band and Grade Pay with the corresponding Level in the Pay Matrix in the revised pay structure recommended by the Seventh CPC and notified in the CCS (Revised Pay) Rules, 2016.

2. In the light of above all cadre controlling authorities of Organized Group A services are hereby requested to amend the SRs as per OM dated 30.08.2016 to bring them inconformity with 7th CPC structure. The undersigned is directed to say that the CCS (Leave) Rules, 1972 have been amended vide Notification G.S.R. No. 438 (E) dated 03.04.2018 (copy enclosed) to bring them in conformity with the Rights of Persons with Disabilities Act, 2016. Accordingly, it has now been decided that leave applied under rule 20, shall not be refused or revoked without reference to the Medical Authority, whose advice shall be binding. Further, any leave debited for the period(s) granted after receipt of the certificate of disability of the Medical Authority, shall be remitted back into the leave account of the Government servant. The Certificate of Disability is required to be issued in Form ‘3A’ which should be signed by a Government doctor of a Government medical board. Further, a Government servant who is granted leave in accordance with the provisions of clause (b) of sub rule (1) of rule 20 of CCS (Leave) Rules, 1972, the provisions of section 20 of the Rights of Persons with Disabilities Act, 2016(49 of 2016) shall, suo-motu, apply.

2. These orders are to be effective from 19.04.2017.
