Subject:– Regarding deletion of note of conditional sanction printed in PPOs of Pre-01.01.2006 retirees Havildar granted Hony Rank of Naib Subedar in compliance of Hon'ble High Courts and AFTs orders.

In compliance of various court orders, conditional sanctions were being issued by AG/P5-4 (Pen/Legal), IHQ (Mob), New beihi in respect of Pre-01.01.2006 retiree Havildars granted Hony rank of Naib Subedar for implementing Gol, Mob letter dated 12.06,2009 in their cases. Accordingly, corrigendum PPOs were/are being issued notifying their pension w.e.f. 01.01.2006 @ Rs. 8450/- for Group “X” and ( Rs. 7750/- for Group .Y and “Z as per the provisions of ibid Mob letter by this office. These Corrigendum PPOs have a Note containing that condition as “’The sanction will, however, be subject to the final outcome of appeal, if any filed before the Hon’ble Supreme Court of India. In the event, the appeal is decided in favour of liaI, the petitioners shall be liable to refund the entire amount paid to him under the ibid sanction”.

2. Of late, it has been observed that large number of such cases of pre 01.01.2006 retiree Hcivildar granted Hony rank of Naib Subedar for grant of pension in terms of Gol, Mob letter dated 12.06.2009 were decided by the various Courts/AFTS. Now, AG/PS- 4 (Pen/Legal), IHQ of Mob, New beihi has started converting conditional sanction into absolute sanction by deleting the ibid contents as printed in Note of Corrigendum PPO of these cases. Large number of such type of sanctions for deleting conditional sanction are being received in this office from Record Offices concerned for issuing Corr. PPO for deleting that Note of conditional sanction in respect of pre-01.01.2006 retiree Havildar granted Hony rank of Naib Subedar.

3. As large number of Corr. PPOs are to be issued in such cases without any
financial bearing or other changes, as such, it has been decided by the competent authority that the note The sanction will, however, be subject to the final outcome of appeal, if any filed before the Hon’ble Supreme Court of India. In the event, the appeal is decided in favour of UoI, the petitioners shall be liable to refund the entire amount paid to him under the ibid sanction” as printed in the respective PPO of those pre-01.01.200Ó retirees Havildars granted Hony rank of Naib Subedar issued in compliance of the Court/AFT orders. may be treated as deleted.

4. It is further reiterated that deletion of ibid note will be applicable only where Service Pension w.e.f. 01.01.2006 @ Rs. 8450/- for Group X and @ Rs. 7750/- for Group and Group Z were notified in compliance of various Courts/AFTS orders in respect of Pre-01.01.2006 retiree Havildar granted Hony rank of Naib Subedar and not in other cases.

Copy of GUI, MoD letter No. 16(3)/2017/D(Pen/Policy) dated 29th January 2019 on the above subject, which is self-explanatory, is forwarded herewith as annexure to this circular for further necessary action at your end.

2. As per ibid Govt. letter, it has been decided that following minimum ceiling shall be applied to the under mentioned casualty pensionary awards:

a. The Disability/Liberalized Disability/War Injury pension (i.e. total of service element plus disability/liberalized disability/war injury element as the case may be), shall be subject to minimum of Rs.18,000/- per month irrespective of degree of disability of the personnel.

b. The amount of special family pension,admissible to the families of Armed Forces personnel, shall be subject to a minimum of Rs.18,000/- per month.

C. The amount of liberalized family pension, admissible to the Child/Children of Armed Forces Personnel, shall be subject to a minimum of Rs.18,000/- per month.

3. All other provisions stipulated in above mentioned circulars which are not affected by the provisions of this letter, shall remain unchanged.

4. the provisions of this letter shall take effect from 01.01.2016

Sub: Revision of pension of pre-2016 pensioners/ family pensioners in implementation of Government’s decision on the recommendations of the 7th Central Pay Commission Concordance tables- regarding.

Sir,

The undersigned is directed to convey that instructions were issued for revision of pension/family pension with effect from 1.1.2016 in respect of Armed Force pensioners/ family pensioners who retired/ died prior to 1.1.2016 vide this Ministry’s letter No. 17(01)/2017(02)/ D(Pension/Policy) dated 5.9.2017. As per the same, revision of pension for pre-2016 Armed Force pensioners/ family pensioners under first formulation, was to be done by notionally fixing their pay in the pay matrix recommended by the 7th Central Pay Commission in the level corresponding to the pay in the pay scale/ pay band and grade pay at which they retired/died. The notional pay fixation in 7th CPC pay matrix has to be arrived by fixing pay under each intervening Pay Commission based on the formula for revision of pay. The revised rates of Military Service Pay, Non Practicing Allowance, where applicable, and X! Group pay & Classification Allowance for JCO/ORs, if applicable, notified in terms of 7th CPC orders, shall also be added to the amount of pay notionally arrived at under the 7th CPC pay matrix and shall be termed as notional reckonable emolument as on 1.1.2016 for determining the revised pension/family pension in terms of para 5 of this Ministry’s letter dated 5.9.2017.

2. Based on past instructions on fixation of pay in various pay commissions, concordance tables for fixation of notional pay for Armed Force personnel who retired/died in various ranks during the 4th, 5th and 6th Pay Commission periods including 3rd Pay Commission for Sailors only) have been prepared and the same are enclosed herewith. In the case of commissioned officers who retired/ died in harness before 1.1.1986, these concordance tables may be used based on their notional pay as on 1.1.1986, which was fixed in accordance with this Ministry’s letter No 1(3)/98/D(Pen/Policy) dated 27.5.1998. Concordance tables for JCO/ORs who discharged/ died in service prior to 1.1.1986 (prior to 1.1.1973 for Sailors), are under preparation and shall be issued separately.

3. These concordance tables have been prepared to facilitate fixation of notional pay of pre-2016 pensioners/ family pensioners by the concerned Record Offices and attached Pay Account Offices in case of JCO/ORs of the three Services and PCDA(0) Pune/ Naval Pay Office, Mumbai / AFCAO New Delhi in case of commissioned officers of Army / Navy / Air Force respectively. Due care has been taken to prepare these concordance tables based on the fitment tables for fixation of pay from 3rd to 4th (only for Sailors), 4th to 5th, 5th to 6th and 6th to 7th Pay Commission. In case of any inconsistency in the concordance tables vis-a-vis the relevant rules instructions, the notional pay and pension family pension of pre-2016 pensioners / family pensioners may be fixed in accordance with the rules / instructions applicable for fixation of pay in the intervening Pay Commission periods.

4. The pension / family pension of pre-2016 Armed Forces pensioners/ family pensioners may be revised, using the appropriate concordance table in accordance with the instructions contained in this Ministry’s above quoted letter dated 5.9.2017.

5. This issues with concurrence of Ministry of Defence (Finance/Pension) vide their UO No. Part.file 1 to 30(01)/2016/Fin/Pen dated 27.09.2018.

E-Pension Payment Order: New Step in the Right Direction

Furthering the Digital India-initiatives of Govt. of India, Principal Controller of Defence Accounts(Pensions), Allahabad has startedissuance of electronic-Pension Payment Orders (e-PPOs) to the pensioners along with their Pension Disbursement Agencies viz., Banks, Defence Pension Disbursement Offices, Post Offices, etc. What began in the first phase, for all Commissioned Officers and JCOs/ORs of Armed Forces from the month of October 2017, has now been extended to all defence pensioners including defence civilians.

Principal Controller of Defence Accounts (Pensions), Allahabad is the sole agency under Ministry of Defence which sanctions Pensions for the Defence Services viz., Army, Coast Guard, Defence Research and Development Organization,General Reserve Engineer Force, Border Roads Organization, Military Engineering Services and other Defence organisations including Defence Account Department and Defence Civilians.

The shift from manual system to e-PPO system is expected to minimize delays in pension disbursement and further revision as and when needed. This initiative also eliminates the occurrence of human errors in data entry at multiple levels.

The next big step in this direction would be digitizing pension documents received from 46 record offices and more than 2900 Heads of Offices. This initiative by PCDA (P) will facilitate better implementation of OROP.

Standard Operating Procedure for REVISION OF PENSION [PRE-2016]
DEFENCE CIVILIAN PENSIONERS AS PER 7th CPC

1. Introduction:
Government of India, Ministry of Personnel, Public Grievances and Pensions, Department of P&PW issued orders vide their OM No. 38/37/2016-P&PW (A) dated 12.05.2017 for revision of Pre-2016 Defence Civilian pensioners as per 7th CPC. These orders were circulated by this office vide Circular number C164 dated 30-05-2017. Pension / family pension in respect of all Defence Civilian pensioners / family pensioners who retired / died prior to 01.01.2016, has to be revised by notionally fixing their pay in the pay matrix recommended by the 7th CPC in the level corresponding to the pay in the pay scale / pay band and grade pay at which they retired / died.

1.1. The estimated number of Defence Civilian pensioners is about 5.5 Lakh. Revising pension, issuance and dispatch of PPO at this scale with the existing manpower was a mammoth exercise in itself. If methods adopted in past were to be deployed, the task would have taken more than 3 years. Dispatch of PPO to Head of Offices was a matter of great concern during similar exercises in past since there were a large number of complaints regarding non-receipt of PPOs sent by this office.

1.2. As per the government orders, the methodology of fixation of pension w.e.f.
1.1.2016 is as under:- The fixation of pension will be done by notional pay fixation under each intervening Pay Commission based on the formula for revision of pay. While fixing pay on notional basis, the pay fixation formulae approved by the government and other relevant instructions on the subject in force at the relevant time are to be strictly followed. 50% of the notional pay as on 01.01.2016 will be the revised pension and 30% of this notional pay will be the revised family pension w.e.f. 1.1.2016. In case of family pensioners who were entitled to family pension at enhanced rate, the revised family pension shall be 50% of the notional pay as on 01.01.2016 and shall be payable till the period up to which family pension at enhanced rate is admissible as per existing Rules. The amount of revised pension/family pension so arrived at shall be rounded off to next higher rupee.

1.3 The higher of the two formulations i.e. the pension/family pension already revised in accordance with OM No. 38/37/2016-P&PW (A) (ii) dated 04.08.2016 i.e., multiplication by a factor of 2.57 or the revised pension/family pension as worked out in accordance with Para above, shall be granted to pre-2016 Defence Civilian pensioners as revised pension/family pension with effect from 01.01.2016.

1.4 These orders would not be applicable for the purpose of revision of pension of those pensioners who were drawing Compulsory Retirement Pension under Rule 40 of the CCS (Pension) Rules, 1972 or Compassionate Allowance under Rule 41 of the CCS (Pension) Rules, 1972. The pensioners in these categories would continue to be entitled to revised pension in accordance with the instructions contained in GOI, DP&PWO.M. No. OM No. 38/37/2016-P&PW (A) (ii) dated 4.8.2016.

1.5 The pension of the pensioners who are drawing monthly pension from the Government on permanent absorption in Public Sector Undertakings / Autonomous Bodies will also be revised in accordance with these orders. For revision of pension of those pensioners who had earlier drawn one time lump sum terminal benefits on absorption in public sector undertakings etc. and are drawing one-third restored pension will be regulated in terms of P&PW OM No. 4/34/2002-P&PW (D) Vol. II dated 23.06.2017, circulated vide this office circular no. C-173 dated 11-08-2017.

2. In terms of Para-2 of GOI, MOD letter No. 17(01)/2017(01)/D(Pension/ Policy) dated 04th September’ 2017, Disability Element of Disability Pension to Armed Forces Pensioners has to be revised by multiplying the existing rate of Disability Element as had been drawn on 31.12.2015 by factor of 2.57 to arrive at revised rate of Disability Element as on 01.01.2016. Further, in terms of Para-5.2 & 5.3 of GOI, MOD letter No. 17(01)/2017 (02)/D(Pension/ Policy) dated 05th September’ 2017, Disability Pensionary awards has to be revised on notional pay fixation method and benefits of broad banding will be given to discharge cases also as in invalided out cases and these will be done by issuing Corrigendum Pension Payment Order (PPO).

3. Now, consequent upon the issue of GOI, MOD letter dated 23rd January, 2018, the cases where Armed Forces Pensioners who were retired/ discharged voluntary or otherwise with disability and they were in receipt of Disability/ War Injury Element as on 31.12.2015, their extent of disability/ War Injury Element shall be re-computed in the following manner given below, before applying the multiplication factor of 2.57 on existing disability/ war injury element as on 31.12.2015 for getting the revised disability/ war injury element as on 01.01.2016 in accordance to Para-2 of GOI, MOD letter No. 17(01)/2017(01)/D(Pension/ Policy) dated 04th September’ 2017.

4. The Note below Para-12 of GOI, MOD letter No. 17(01)/2016-D(Pen/Pol) dated 29th October, 2016 (circulated vide Circular No. 570 dated 31.10.2016) stands deleted. In other words, quantum of additional pension available to old age pensioners after attaining the age of 80 years and above shall also be admissible on revised disability/ war injury element.

5. It is also stated that PDAs may take utmost care during revision of Disability/War Injury Element as per this order in those cases where the pensioners who are in receipt of 50% of Disability/ War Injury Element of Disability/ War Injury Pension. If the individual has already been given rounding of benefit through PPO (in invalided out cases) then rounding of benefit in such cases should not be given. However, where his disability was assessed as 50% in discharge cases then it will be rounded to 75% as mentioned in Para-3 above. If the PDAs found any problem regarding
identification of such cases the same may please be forwarded to Audit Section of this office.

6. All Pension Disbursing Agencies handling disbursement of pension to the Defence Pensioner are hereby authorized to pay benefit of rounding off disability/ war injury and additional pension as per Para 3 & 5 above without any further authorization from the concerned Pension Sanctioning Authorities.

7. Provisions of GOI, MOD letter No. 17(01)/2017(01)/D(Pen/Policy) dated 23rd January, 2018 shall take effect from 01.01.2016.
